Since we are not medical professionals we only restrict our role to help locate medical services providers and their credibility for treatment in India. We neither recommend nor support any particular medical facility inside India other than to locate and refer it to for your choice and decision. It is desirable and highly recommended for you to discuss and take advice of your personal medical doctor before making any decision for medical treatment in India When you have taken an informed decision and entered into a formal contract with MPD with regard to medical treatment at a medical facility of your choice, we undertake to make your journey comfortable and without any hassle until the contracted treatment is administered and recuperation and post treatment care, if any, is taken care of and you are safely back to your home. Although we take all the care and precaution in disseminating information regarding medical treatment to our customers in India and help our customer making an informed decision, it is you the patient, who assume all responsibility for choosing a particular medical facility and any particular doctor for your medical procedure..

1.Terms & Conditions Of Patient Medical Treatment Booking In India
We facilitate your contact with, and provide information about doctors in India and provide information about their credentials in order for you to make informed decisions. We do not, however, recommend any preferred or specific doctors for your desired medical treatment. We encourage and advise you to discuss all medical issues with your medical doctor at home location, before making a decision on medical treatment in India Through our medical tourism affiliates around the world and our in-depth research we provide information about available medical treatment and recuperation and packages to assist you making an informed decision.

You agree to assume all responsibility in connection with choosing any doctor for your desired procedure. We assume no responsibility or liability for any treatment or other services rendered by any doctor, or for any malpractice claims and other claims that may arise directly or indirectly from any such advice, treatment or other services.

The Participant / Patient or his / her family members / relatives / escorts / friends making the booking on behalf of the Participant / Patient shall read carefully the terms and conditions mentioned herein before filling and signing the registration form. The terms and conditions as set out in the registration form are also set out in the Package quote, a copy of which has been provided to the Participant / Patient or his / her family members / relatives / escorts / friends making the booking on behalf of the Participant / Patient. The Participant / Patient (and his / her family members / relatives / escorts / friends making the booking on behalf of the Participant / Patient) shall sign this document. The signing of the terms & conditions document by the Participant / Patient (and his / her family members / relatives / escorts / friends making the booking on behalf of the Participant / Patient) shall mean acceptance in totality of the terms and conditions contained herein by the Participant / Patient (and his / her family members / relatives / escorts / friends making the booking on behalf of the Participant / Patient). The signed terms & conditions documents with payment receipt shall be binding on the Participant / Patient (and his / her family members / relatives / escorts / friends making the booking on behalf of the Participant / Patient) and shall constitute a contract between MPD Services and the Participant / Patient (and his / her family / members / relatives / escorts / friends making the booking on behalf of the Participant / Patient) on the Participant / Patient (and his / her family members / relatives / escorts / friends making the booking on behalf of the Participant / Patient) signing the terms and conditions document and making payment towards the Package. MPD Services (service facilitator for Medical Tourism India) does not control or operate any Treating Institution, neither does it operate or control any facility or service provided by the Treating Institution mentioned in the Medical Treatment Package. MPD Services takes care in selecting all the ingredients in the Medical Tourism Package and has no control whatsoever in running the Treating Institution and hence, MPD Services cannot be made liable / responsible for any delay, default, failure, improper services / deficiency in services provided by the Treating Institution and / or for any injury, sickness, accident, discomfort, death, loss or damage of any kind whatsoever which may arise due to any act of negligence, deficiency or default in services, of the management or employees of the Treating Institution. MPD SERVICES assumes no responsibility or liability whatsoever, specific or nonspecific, for any or specific treatment or other services given by the doctor or the medical facility of patient’s choice arising out of the treatment administered.

2.Treating Institutions
The Treating Institution shall be solely responsible for all treatment to be provided by it to the Participants / Patient, including but not limited to surgical, medical, wellness, beauty and all related queries, opinions and complications and MPD Services shall not be responsible for the same. Any emergency, complication or medical requirement, of whatsoever nature, arising with regard to the Participant / Patient’s treatment due to the Participant / Patient’s present or past illness or the side effects / allergy of / to drugs or lack of adequate treatment, pre, during or post treatment will be the absolute responsibility of the Treating Institution and / or the treating Doctor, as the case may be, and MPD Services shall not be responsible for the same. If the Participant / Patient (and his / her family members / relatives / escorts / friends making the booking on behalf of the Participant / Patient) has any complaint in respect of the services rendered by the Treating Institution, he / they should forward such complaints directly to the Treating Institution without any recourse to MPD Services.

3.Listed Tour / Travel services
You can choose any tour / travel services such as transfers / limo Services / hotel booking / guest house booking / service apartment booking / air and or train tickets, translator services / recuperative holidays etc. to be combined with your Healthcare package and MPD Services would be pleased to provide you the same. You are welcome to ask further details on tours, services offered, cost and terms offered by our company’s Leisure Holidays department.

3(a)Travel and Tour Services

MPD SERVICES Leisure Holidays department shall not be responsible for any delays & alterations in the program or expenses incurred - directly or indirectly - due to natural hazards, flight cancellations, accident, breakdown of machinery or equipment’s, breakdown of transport, weather, sickness, landslides, political closures or any untoward incidents. We shall not be responsible for any loss, injury or damage to person, property, or otherwise in connection with any accommodation, transportation or other services, resulting - directly or indirectly - from any act of GOD, dangers, fire, accident, breakdown in machinery or equipment, breakdown of transport, wars, civil disturbances, strikes, riots, thefts, pilferage's, epidemics, medical or custom department regulations, defaults, or any other causes beyond our control. All itineraries are sample itineraries, intended to give you a general idea of the likely trip schedule. Numerous factors such as weather, road conditions, the physical ability of the participants etc. may dictate itinerary changes either before the tour or during the trail. We reserve the right to change any schedule in the interest of the trip participants' safety, comfort, general wellbeing and convenience. We do not have any insurance policy covering the expenses for accident, sickness, loss due to theft, or any other reasons. Visitors are advised to seek such insurance arrangements in their home country before commencing travel. All baggage’s & personal property/s at all times are at the client's risk. In case of changes in the rates quoted by hotel and airlines, we can change the rates quoted according to the modifications by hotels or airlines without any prior notice. All hotel bookings are based on usual check in and check out time of the hotels until unless indicated in the itinerary.

5.MPD Services Healthcare packages
The Healthcare packages offered by MPD Services in association with the premier Healthcare providers will be provided on the following Terms and Conditions.

5(A) Medical Evaluation and Quotation estimate
MPD Services arranges for you complementary e-mail consultations with the Healthcare professional after receiving the medical history form and diagnostic reports from you. MPD Services suggests you to ask the attending consultant / Doctor's all the questions you may have, during these consultations. The initial consultations would be complementary and you and the Healthcare professional are under no obligation until after your pre-treatment consultation.

MPD Services reminds you that all kind of Healthcare procedures, transplants, replacements or surgical or otherwise carry certain risks and therefore you and the Healthcare professional have to agree about the anticipated outcome of the procedure to be undertaken.

After the initial pre-treatment consultations and evaluation of medical records, MPD Services would quote you the cost of the procedure. The quotation would include only the services detailed in it. If any non-predicted costs appear after the face-to-face consultations and subsequent pre-treatment medical examination or diagnostic report once you are in India, they will be properly detailed in order to obtain your authorization and consent. Before the procedure you are required to pay for full procedure / treatment cost to the treating institution via us to book services on confirmed basis / medical consultants appointment / operation theatre booking / nursing care / hospital ward or room booking and other related medical teams appointment for your / patients treatment on firm basis at the treating institution.

5(B).The quotation presented would not include:
Insurance and any additional medical expenses for the medications or procedures in case of unforeseen complications. Make sure you discuss this with the Doctor before the procedure and or advised to take medical as well as travel insurance before arriving into India for your medical treatment. International Airfare / International or Domestic Air tickets / India Visa etc. are not included in the quotation.

5(c) Payment mode and terms:
Payment Stages:
On getting your approval for the treatment – 25% of the total quotation estimate in Advance (Non- refundable). 30 days prior to arrival into India – Balance 75 % of the total quotation estimate. Also note that, in some critical cases it is mandatory to pay full amount thus quoted for booking medical treatment / procedure services on priority / emergency basis and will be binding on the patient to pay MPD Services full advance payments.

6.MPD SERVICES Cancellation Policy:

Once in India, if the treatment or booked Hotel Room or post hospital Recuperative Holidays is cancelled then following non-refundable amount over given cost estimates will apply. For medical reasons 25% Due to patient’s decision 100%

7.Refund
In regard to refund of unused / unutilized services (which are paid for and cancelled in advance), the refund amount would be worked out on the basis of cancellation policy as described above and the money would be accordingly refunded to the person who has made the payment to us. Please note that the refund process may take 3-5 weeks due to Indian banking procedures.

8.Limitations of Liability
YOU AGREE THAT NEITHER WE NOR OUR INTERNATIONAL AFFILIATES WILL BE LIABLE FOR ANY DAMAGES RESULTING FROM YOUR USE OF, OR RELIANCE UPON, THIS SITE, ANY SITE MATERIALS, OR ANY SERVICES OBTAINED ON OR THROUGH THIS SITE. IN THE EVENT OF ANY PROBLEM WITH THIS SITE, ANY SITE MATERIALS, OR SERVICES OBTAINED ON OR THROUGH THIS SITE, YOU AGREE THAT YOUR SOLE REMEDY IS TO CEASE USING SUCH ITEMS.
YOU AGREE THAT UNDER NO CIRCUMSTANCES will MP DOMINIC CO OR ANY OF OUR OR THEIR DIRECTORS, OFFICERS, MEMBERS, EMPLOYEES, AGENTS, REPRESENTATIVES, SERVANTS, ATTORNEYS, PREDECESSORS, SUCCESSORS OR ASSIGNS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOST PROFITS AND DAMAGES THAT RESULT FROM INCONVENIENCE, DELAY, OR LOSS OF USE) ARISING OUT OF USE OF THIS SITE, ANY SITE MATERIALS, ARRANGEMENTS MADE BASED ON INFORMATION OBTAINED ON OR THROUGH THIS SITE, OR PRODUCTS OR SERVICES OBTAINED ON OR THROUGH THIS SITE, EVEN IF WE OR THEY HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9.Indemnity
You agree to defend, indemnify, and hold harmless MP DOMINIC CO and our affiliates, and our and their respective directors, officers, members, employees, agents, representatives, attorneys, successors and assigns, from and against any and all claims, proceedings, damages, injuries, liabilities, losses, costs and expenses (including reasonable attorneys' fees and litigation expenses), relating to or arising from (i) your use of this Site, any Site Materials, or services obtained on or through this Site, (ii) any arrangements you make based on information obtained on or through this Site, or (iii) any breach by you of our Terms & Conditions

10.Discrepancies & Disputes
In case of Medical discrepancy or conflict for immutability of malpractice carried out by the patient, all the concerned parties establish and agree that all judicial action must be carried out by the patient towards the medical professional / healthcare centre / hospital only within the jurisdiction of the city of Aluva in the State of Kerala , India, and that action will not be extended towards www.barasharabia.com , it’s managing company MP Dominic co or any of it’s proprietor and employees since it is a company that puts at the disposition of the patient different professional options through listing their services without exercising / practicing medicine professionally.
If there is any dispute about or involving the web site and / or the service, by using this web site, you agree that the dispute will be governed by the laws of the Union of India. You agree to personal jurisdiction by and venue in the jurisdiction of the city of Aluva in the State of Kerala , India

14. Miscellaneous:
This Agreement constitutes the entire agreement between the parties, and supersedes all prior written or oral agreements or communications with respect to the subject matter herein. If any provision of this Agreement is held to be unlawful, void or unenforceable, then such provision shall be severable without affecting the enforceability of all remaining provisions. MPD in its sole discretion may amend this Agreement, and your use of any Website after such amendment is posted on such website will constitute acceptance of it by you.
